General terms of sale

1. The seller

2. Scope
These terms apply to every sale of an artwork concluded by OA Fine Art, in the gallery or at a distance (email, phone, video call), with a consumer or a business client. The website oafineart.com presents the artworks but does not allow online orders. Any specific terms agreed in writing prevail over these.
3. The artworks
Each artwork is described in good faith: artist, title, year, medium, dimensions and condition. Photographs are as faithful as possible; slight differences in colour or texture may nonetheless arise from the screen used. We encourage you to view the artwork in the gallery or to ask for additional images before any purchase.
Each artwork comes with a certificate of authenticity and an invoice bearing the particulars required by French Decree no. 81-255 of 3 March 1981. Acquiring an artwork does not transfer its copyright: reproduction remains subject to the consent of the artist or their estate.
4. Prices
Prices are given on request, in euros, all taxes included. The gallery's written offer states the price of the artwork and, where applicable, framing, packing, shipping and insurance costs. Import duties and taxes outside the European Union are borne by the buyer.
5. How a sale is concluded
- You send us an enquiry about an artwork.
- The gallery sends you a written offer: description, price, costs, delivery terms and lead time. It is valid for 7 days.
- The sale is concluded upon receipt of your written acceptance and full payment. The artwork is then reserved for you and withdrawn from sale.
In the gallery, the sale is concluded upon signature of the order form or upon payment.
6. Payment
The price is payable in full before the artwork is handed over or shipped, by bank transfer or credit card. Leasing may be offered through a partner; it is governed by a separate agreement, concluded directly with that provider and subject to its approval.
7. Ownership and risk
The artwork remains the property of OA Fine Art until the price has been paid in full. Risk passes to a consumer client when they take physical possession of the artwork, and to a business client when it is handed to the carrier.
8. Handover and delivery
The artwork is handed over in the gallery or shipped by a specialist fine-art carrier, packed and insured for its value. The lead time is stated in the offer; failing that, it does not exceed 30 days from the conclusion of the sale. For shipments outside the European Union, the gallery completes the export formalities required for cultural goods.
On receipt, check the packing and the artwork in the carrier's presence and note any reservation on the delivery slip. Report any damage to us within 48 hours at contact@oafineart.com, with photographs.
9. Right of withdrawal
For a sale concluded at a distance, a consumer client has 14 days from receipt of the artwork to withdraw, without giving any reason (article L.221-18 of the French Consumer Code). They inform us by an unequivocal statement — email or letter — or using the form below.
The artwork is returned within the following 14 days, in its original packing and insured, at the client's expense. We refund the price and the initial delivery costs within 14 days of the withdrawal; the refund may be withheld until the artwork has been received in perfect condition.
The right of withdrawal does not apply to sales concluded in the gallery, or to artworks made to order according to the client's specifications (article L.221-28, 3° of the French Consumer Code).

10. Legal warranties
A consumer has two years from delivery to invoke the legal warranty of conformity if a lack of conformity appears. During that period, they need only establish the existence of the defect, not the date it appeared. The warranty entitles them to repair or replacement; failing that, to a price reduction or cancellation of the contract (articles L.217-3 et seq. of the French Consumer Code).
A consumer may also invoke the warranty against hidden defects under articles 1641 to 1649 of the French Civil Code, within two years of discovering the defect, and then choose between cancelling the sale and a price reduction.
For a unique original artwork, replacement being impossible, the warranty is exercised by a price reduction or a refund. To invoke these warranties: contact@oafineart.com.
11. Authenticity
OA Fine Art guarantees the authenticity of every artwork sold, as stated on its invoice and certificate. Should a lack of authenticity be established, the sale would be cancelled and the price refunded in full.
12. Personal data
Data provided for a sale is processed in accordance with our privacy policy.
13. Complaints and mediation
Any complaint should be sent in writing to OA Fine Art, 15 rue de Miromesnil, 75008 Paris, France, or to contact@oafineart.com. If it has not been resolved, a consumer client may refer the matter free of charge, within one year of their complaint, to the consumer mediator: CM2C, 49 rue de Ponthieu, 75008 Paris, France — www.cm2c.net.
14. Governing law and jurisdiction
These terms are governed by French law, without prejudice to the protective provisions of the law of the consumer's country of residence (Rome I Regulation no. 593/2008). The United Nations Convention on Contracts for the International Sale of Goods is excluded. Any dispute with a business client falls under the exclusive jurisdiction of the Paris Commercial Court.
